To participate in the Program, you must:

• Be at least 18 years of age (or age of majority in your jurisdiction)

• Have an active, public social media account with a minimum of 5,000 engaged followers on at least one major platform (Instagram, TikTok, YouTube, or Pinterest)

• Maintain a minimum engagement rate of 2% on your primary platform

• Reside in a country where we currently ship (United States)

• Have no previous violations of our brand guidelines or terms

• All applications must be submitted through our official Creator Program page

• Applications must contain accurate and current information

• You must provide examples of previous brand collaborations or content

• Submission of an application does not guarantee acceptance into the Program

• We reserve the right to verify all information provided, including follower authenticity

Selection is at our sole discretion based on factors including but not limited to:

• Content quality and aesthetic alignment

• Audience engagement and demographics

• Brand fit and values alignment

• Past performance with brand collaborations

• Geographic location

• Current program capacity

• Applicants will be notified of their status within 5-7 business days

• We reserve the right to reject any application without providing specific reasons

• Accepted creators will receive a detailed content brief and agreement

• Products provided are at our sole discretion

• Typically includes 2-3 items per collaboration (retail value $100-200)

• Products may include items from current or upcoming collections

• We will make reasonable efforts to provide appropriate sizes and styles

• Products are provided in exchange for content, not as gifts

Selection is at our sole discretion based on factors including but not limited to:

• Content quality and aesthetic alignment

• Audience engagement and demographics

• Brand fit and values alignment

• Past performance with brand collaborations

• Geographic location

• Current program capacity

• Products will be shipped at no cost to the creator

• Shipping typically occurs within 7-10 business days of agreement acceptance

• Creator is responsible for providing accurate shipping information

• Creator must confirm receipt of products within 48 hours

• Lost or stolen packages must be reported immediately

• Products must be kept in excellent condition and steamed/ironed for content creation

• Products become creator's property only AFTER fulfilling content requirements

• Products may NOT be sold, traded, or given away before content completion

• Products must be featured as styled/intended (not altered or modified)

By accepting products, you commit to creating and posting the following within 14 days of product receipt:

Minimum Requirements:

• One (1) high-quality in-feed post on Instagram OR TikTok featuring the products

• One (1) Instagram or TikTok Stories showcasing different angles/styling options

• All content must prominently feature the provided products and info on where to purchase

• Content must meet quality standards consistent with your portfolio

Content Specifications:

• Feed posts must be solo posts (not carousel with other brands)

• Products must be clearly visible and identifiable

• Info on where to purchase is clearly stated verbally or in writing

• Lighting and image quality must be professional-grade

• Content must align with a brand aesthetic

• First Story must be posted within 7 days of receiving products

• Feed post must be published within 14 days of receiving products

• All content must remain live for minimum 60 days

• Deleted or archived content before 60 days constitutes breach of agreement

Creators who exceed minimum requirements may receive:

• Priority selection for future campaigns

• Additional products from current collection

• Invitation to paid collaborations

• Ambassador program consideration

All content must:

• Be original and created specifically for this collaboration

• Maintain professional photography/videography standards

• Feature good lighting and clear product visibility

• Include creative styling that showcases products attractively

• Avoid filters that significantly alter product colors

Content must NOT:

• Feature competitor brands in same post

• Include offensive, controversial, or inappropriate material

• Misrepresent products or make false claims

• Violate any platform community guidelines

• Associate products with illegal activities or substances

• Use #Ad or #Sponsored in the first line of captions

• Include "Gifted by @O5Apparel" clearly in caption

• Failure to properly disclose is grounds for immediate program termination

• Content must achieve minimum 2% engagement rate

• Severely underperforming content may affect future participation

• Use of engagement pods or fake engagement is prohibited

Within 7 days of final post, you must provide:

• Screenshots of all created content

• Basic performance metrics (likes, comments, shares, views)

• Any notable feedback or customer inquiries

If you fail to meet content requirements:

• You will be immediately removed from the Program

• You may be invoiced for full retail value of products received

• You will be ineligible for future collaborations for 12 months

• We reserve the right to pursue legal action for breach of contract

• Your information may be shared with other brands in our network

Extensions may be granted ONLY for:

• Documented medical emergencies

• Natural disasters

• Platform technical issues (with proof)

• Requests must be made BEFORE deadline with supporting documentation

By participating, you grant O5 Apparel:

• Unlimited, worldwide, perpetual license to use all created content

• Right to edit, modify, and repurpose content

• Permission to use on all marketing channels (social, web, print, etc.)

• Right to sublicense content to retail partners

• Permission to use your name, handle, and likeness

• You retain copyright ownership of your content

• You may use content in your portfolio

• You warrant all content is original and doesn't infringe third-party rights

• This creates an independent contractor relationship, not employment

• You are responsible for your own taxes on product value

• No benefits, insurance, or employee protections apply

• No exclusivity required unless specifically agreed

• However, cannot promote direct competitors within 30 days

• Must disclose other fashion brand partnerships

We may terminate immediately for:

• Failure to post required content

• FTC disclosure violations

• Content quality below standards

• Misrepresentation or false information

• Violation of any terms

• Must return products if content not completed

• Completed content licenses remain in effect

• Ineligible for future programs

• Our maximum liability is limited to product retail value

• Not responsible for allergic reactions or fit issues

• No liability for lost revenue or opportunities

You agree to indemnify O5 Apparel against all claims arising from:

• Your content or actions

• Violation of these terms

• Failure to disclose properly

• Infringement of third-party rights

By participating, you agree to:
